Terms and Conditions
PART 1 – SUMMARY AND INTERPRETATION
AGREEMENT between Nicole Tomeo Hair and Make Up (Artist) and “Client”:
“Accommodation Expenses” means accommodation costs incurred by an Artist in relation to a Booking due to a long commute and an early start time.
“Additional Costs” means any costs required for the provision of the Artist Services for a particular Booking including, but not limited to:
- (a) Travel Expenses;
- (b) Early Fees;
- (c) Parking Expenses; and
- (d) Accommodation Expenses.
“Artist” refers to Nicole Tomeo Hair and Makeup Artist and/or Hair Stylist
“Artist Services” means the makeup, hair and other beauty services provided by Nicole Tomeo;
“Booking” means a booking for Nicole Tomeo to provide you with particular Artist Services secured by payment of a Deposit.
“Client” means the person or legal entity listed on the purchase invoice and includes anyone acting on their behalf;
“Deposit” means a non-refundable, non-transferable payment reflecting a percentage of the total Service Quote amount for a Booking Enquiry (as determined by us) that is payable in order to secure a Booking;
“Deposit Invoice” means the tax invoice in respect of the Deposit amount;
“Early Fee” means costs that may be applied by an Artist due to an early appointment time;
“Fees” means the fees associated with a Booking as stipulated by us including any Additional Fees;
“Final Booking Details” means all details relevant to your Booking including the Booking destination, Booking date, Booking time and the Artist Services to be provided.
“Final Invoice” means the tax invoice in respect of the outstanding Fees associated with a Booking (the total Fees reduced by any Deposit paid);
“Parking Expenses” means costs for Nicole Tomeo used for parking at the Booking destination on the Booking Date.
“Travel Expenses” means costs associated with Nicole Tomeo travelling to Booking destination/s. These expenses may vary and are subject to the particular Artist’s terms and conditions. If Nicole Tomeo is required to fly to the Booking destination appropriate flight, transfer, allowance and other opportunity costs will be outlined in your Quote;
“Trial” means an appointment with the Artist prior to the Booking Date to try and discuss the look and style prior to the Booking Date.
PART 2 – Nicole Tomeo Hair and Make Up
All contracts/dealings between Nicole Tomeo Hair and Make Up (ABN ) and any person (‘Client’) relating to any goods or services provided and supplied by Nicole Tomeo to the Client through the website nicoletomeo.com.au (‘Website’) are subject to the terms and conditions of trade set out below (‘these Terms’).
By using the Website, the Client agrees to be bound by these Terms.
Nicole Tomeo Hair and Makeup has the right to remove or vary these Terms at any time without notice. It is the Client’s responsibility to be aware of any changes made to these Terms and by continuing to use and visit the Website the Client agrees to be governed by these Terms and Conditions.
Nicole Tomeo Hair and Makeup reserves the right to withdraw the Services without notice and will NOT be liable (if for any reason) the Website is unavailable during any period.
Please Note: Nicole Tomeo Hair and Make Up may restrict access to the Website without notice at any time.
- Any Order, Booking Enquiry and/or purchase made by you using this Site is an acknowledgement by you that:
- (a) you are over the age of eighteen (18) years, or have obtained the relevant permission from a parent or guardian; and
- (b) you accept the Agreement and agree that you have entered into a binding legal contract with us in relation to the Agreement.
PRIVACY POLICY
INFORMATION WE MAY COLLECT FROM CLIENTS – In order to provide better service to our valued customers, Nicole Tomeo Hair and Makeup may request personal details such as your name, address, telephone number or e-mail address. If you choose to withhold requested personal information, Nicole Tomeo Hair and Makeup may not be able to provide you with the customer service you require should that depend on the collection of that information, particularly if the collection of that information is required by law.
Nicole Tomeo Hair and Makeup will not sell or disclose the Clients personal information/details to any third party without the clients consent unless in the purpose of purchase/deposit/delivery or if necessary to comply with laws, investigations or legal proceedings. For transaction security for debit and credit card payments, Nicole Tomeo Hair and Makeup Artist uses ‘Stripe’.
PROPERTY
All content made available to the client via the Nicole Tomeo Hair and Makeup Website is property of Nicole Tomeo Hair and Makeup Artist.
The client can view, download, copy and/or print the images accessible on the Nicole Tomeo Hair and Makeup Artist Website for personal use only and may NOT be altered in anyway.
The customer is not permitted to alter or re-produce the images on the Nicole Tomeo Hair and Makeup Artist Website in any manner without permission from Nicole Tomeo.
The customer may NOT remove any trademarks made by Nicole Tomeo Hair and Makeup on any images, campaigns or marketing materials.
PART 3 – OUR TEAM SERVICES
Nicole Tomeo Hair and Makeup Artist, when you submit a Booking Enquiry, you are engaging me to provide the Client Services.
Nicole Tomeo will provide services to you and we are solely responsible for booking the services and providing relevant information in securing appointments with deposits. Nicole Tomeo is responsible for collecting the remaining balance of service from the client.
To book any services you must submit a Booking Enquiry to us through the Site at https://www.nicoletomeo.com.au.
BOOKING: When confirming your booking request we will prepare a quote for the total amount owing including any additional costs. Once confirmed by client, we email a deposit invoice with relevant information to make payment to secure your booking.
All enquiries and communication regarding your booking and fees must be done directly through Nicole Tomeo, owner and booking administrator. Valet parking is mandatory if available at accomodation as the Artist (Nicole Tomeo) may have heavy makeup/hair kits and lighting. This expense will be billed directly to you room as part of the Parking Expense agreement.
COVID-19 VACCINE UPDATE: If you need to cancel due to COVID related reasons, a credit note will be created on your behalf to use on future services &/or products. To receive a full refund, you must show proof of a positive COVID result from the Australian Government.
DEPOSIT PAYMENTS: A Deposit payment for any service with Nicole Tomeo Hair and Makeup Artist is non-refundable or transferable and is required when any makeup booking is requested for it to be confirmed and secured. Without payment made, we cannot promise that your requested date or time will remain available.
BALANCE PAYMENT TO ARTISTS: All monies must be paid in full seven (7) days before day of service if paying by direct debit/bank transfer. Artist bank details can be provided upon request. If cash payment is preferred, monies must paid before makeup services commence on the day directly to the Artist.
TRIALS: For an additional Fee, you may request a Trial appointment with the Artist to discuss and try the desired look before your big day. If you would like a trial, you will receive a deposit invoice to secure your booking with the artist. Balance payment is made directly to the artist on the day via direct debit or cash.
PAYMENT OPTIONS WITH NICOLE:
Nicole Tomeo Hair and Makeup Artist accepts Cash or Bank Transfer. No facility for credit card payments at this time. All prices are in Australian Dollars. Invoices are sent to your desired email address once booking is confirmed and can be paid online.

BOOKING CHANGES: After a booking is secured and deposit is paid, any requests to alter your booking requires notice. We will do our best to make these changes for you however it is subject to the Artist’s availability and scope of work on that day. We will make effort to accomodate as best we can.
Please Note: The Artist is not obligated to service beyond agreement when booking is made, including timings on the day. You are paying per face not per hour. If you cause a delay to the booking agreed, you acknowledge this may compromise the delivery of service. We allocate estimated timings for each person on behalf of the artist which is emailed when bookings are confirmed.
CANCELLATIONS: Deposits are non-refundable and non-transferable (unless impacted by COVID19 or serious misadventure). If related to COVID or serious misadventure, a. credit note will be created on your behalf to use for future bookings &/or services. A full refund will apply if can provide proof of a positive covid result from the Australian Government.
If you fail to attend or be available for a Booking you are not entitled to a full refund, however an arrangement will be made with the Artist.
In the unliklely event that the Artist cancels, which are not within our reasonable control, we will get in contact with you as soon as possible and send another similar artist (in experience and style) to you along with any relevant notes/photos (if a trial has been done). If no artist on our team is available and we are unable to fulfil your booking, a full refund will apply as well as recommendations of other artists in the area.
OPENING HOURS
Nicole Tomeo Hair and Makeup Artist’s hours vary week to week depending on bookings. A surcharge of 10% will incur if booking is earlier than 6:30am or later than 6:00pm on any day and will also apply on Sundays. Please email nicolehairmakeup@hotmail.com or text our MOBILE for bookings.
The following days are an exception:

Easter Sunday – CLOSED
Christmas Day – CLOSED
New Years Day – CLOSED
Nicole Tomeo Hair and Makeup Artist will inform you via email or SMS if makeup services are unavailable for any other days or times. Please Note: These Public Holidays can be booked if required however a surcharge of $50.00 will incur.
TRAVEL CHARGES
A minimum of four (4) faces applies for any booking.
A minimum travel fee of $50.00 applies, Toll charges & Parking fees may also apply. If valet parking is available, this will be charged to your room in accordance to this agreement.
Touch up services (after the ceremony / before photos) can be added with a $50 per hour fee. Alternatively, an exclusive wedding day rate can be tailored for your needs.
PRICE LIST
Nicole Tomeo Hair and Makeup Artist has the right to change any price at any time without notice to the client, unless the client has placed an order at a stipulated price (then the alteration in price is not applicable).When booking any service with Nicole Tomeo Hair and Makeup, the client agrees to these prices. A minimum of $200.00 for any hair/makeup booking applies.

DESTINATION & LOCATION WEDDINGS
Nicole Tomeo is able to travel within Australia for destination Weddings & Events.

BOOKING TERMS & CONDITIONS
Hair and Makeup Trials are highly recommended for bridal hair and makeup as they are invaluable to exchange/gather information and ideas to create the perfect, flawless look for your special day.
Booking Fee. To secure your hair/makeup booking, a non-refundable or transferable deposit is required.
Please note: Failure to pay this by the Due date will result in your date being re-opened to other bookings.
Once the booking fee is paid, your date will be secured, confirming that you also agree to our booking terms and conditions.
Please note – Booking a trial does not secure your date. A Booking fee is still required.
This booking Fee will be deducted from your final invoice. Final Payment. A month out from your wedding, an online invoice will be sent to you with your balance owing. Cash can be paid prior to Hair and Makeup commencement on the day of service or alternatively payment can be made by the link on your invoice or bank transfer prior to the booking date.
Cancellations.
Booking fees will not be refundable.
Cancellations made within 7 days of booking will result in final invoice amount needing to be paid minus travel charges.
Booking Changes can be made in the lead up to your big day and we will do our best to try to cater to all your needs in making your day as stress free as possible.
Please note, we sometimes have two brides per day so timing changes may be limited so please let us know as soon as possible to avoid any disappointment.
BRIDAL HAIR AND MAKEUP
Booking date needs to fall within the next 12 months.
Additional fees apply for out of hours (before 7am and after 3:30pm.)
Sunday appointments incur an additional 10% surcharge for public holidays.
Please note: You are paying per face, not per hour. Travel fees apply.
